These Terms & Conditions (“Terms”) govern your access to and use of the website and services offered by Magnolia MD Metabolic and Wellness LLC. By accessing or using our website or services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the website or services.
Our services are available only to individuals who are at least 18 years of age and who are physically located in and residents of the State of Georgia, where our physician is licensed. By using our services you represent that you meet these requirements. We do not knowingly provide services to anyone under 18 or outside Georgia.
Magnolia MD offers physician consultations and, where clinically appropriate, a personalized weight and metabolic health program delivered by telehealth. Any prescription is issued only after a consultation and clinical evaluation by our Provider, and only when the Provider determines it is appropriate and safe for you. Prescribed medication, if any, is dispensed by a licensed pharmacy. Enrollment, program details, and clinical decisions are at the sole discretion of the Provider.
Health information you provide as a patient (for example, your medical history, treatment, and communications with the Provider) is Protected Health Information and is governed by the Health Insurance Portability and Accountability Act (HIPAA) and by our separate Notice of Privacy Practices, not by these Terms or our website Privacy Policy. PHI is collected and maintained only within our HIPAA-compliant patient platform, not through this general website. Nothing in these Terms limits your rights under HIPAA. Please review our Notice of Privacy Practices, provided to you as part of your patient intake.
The initial consultation is offered at no charge. If you choose to enroll, our program is a cash-pay membership (we do not bill insurance; many members use an HSA or FSA card). Pricing is presented to you before enrollment and is set out in your Fee-for-Service Agreement. By providing a payment method, you represent that you are authorized to use it and that the information you provide is accurate. Baseline laboratory testing, if required, may be billed separately by the laboratory.
Cancellation and refund terms are governed by your Fee-for-Service Agreement, which forms part of your relationship with us. Because prescribed medication is a personalized medical product dispensed for a single patient, it cannot be returned or refunded once shipped, for health and safety reasons. Consultation fees, membership terms, and any applicable refunds are addressed in that Agreement.
If you opt in, we may send you text messages related to your inquiry, appointments, and program. You can cancel the SMS service at any time by replying STOP; we will confirm your unsubscribe by SMS, after which you will no longer receive texts from us. To rejoin, opt in again as you did initially. Reply HELP for assistance, or email us at [email protected]. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply. You will receive approximately 3–5 messages per month and typically no more than 10. Contact your wireless provider with questions about your text or data plan.
You agree to provide accurate information, to use the website and services only for lawful purposes, and not to misuse, disrupt, or attempt to gain unauthorized access to the website or our systems. You are responsible for any activity under any account credentials you create, and for keeping those credentials secure.
The website and its content (excluding content you provide), features, and functionality are and will remain the exclusive property of Magnolia MD Metabolic and Wellness LLC and its licensors, and are protected by copyright, trademark, and other laws. Our name, logo, and trademarks may not be used without our prior written consent.
Our website may contain links to third-party sites or services we do not own or control (for example, our patient platform or payment processor). We are not responsible for the content, policies, or practices of any third-party sites, and we encourage you to review their terms and privacy policies.
The website and services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure. We make no guarantee regarding any particular health outcome or amount of weight loss.
To the maximum extent permitted by applicable law, in no event will Magnolia MD or its suppliers be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of, or inability to use, the website. To the extent permitted by law, our total liability for any claim relating to the website will not exceed the amount you paid us for the service giving rise to the claim, or $100 if you have not paid us. Nothing in these Terms limits liability that cannot be limited under applicable law. Some states do not allow certain limitations, so some of the above may not apply to you.
We may suspend or terminate your access to the website or services at any time, with or without notice, including if you breach these Terms. You may stop using the website and services at any time. Termination of website access does not by itself terminate any active clinical relationship, which is governed by your patient agreements.
These Terms are governed by the laws of the State of Georgia, excluding its conflict-of-law rules. If you have a concern or dispute, you agree to first contact us to try to resolve it informally.
We may modify these Terms from time to time. If a change is material, we will make reasonable efforts to provide notice. Your continued use of the website after changes take effect constitutes acceptance of the revised Terms.
